A major female client, instituted a claim in her capacity as the claimant and biological mother of her minor son where her minor son was involved in a collision as a pedestrian. As a result of the collision the minor child suffered the following injuries:
Left distal fibular fracture.
On 15 April 2024, the claim was settled with 100% concession for the merits of the case, and R 4 635 624.00 for the quantum of the claim (excluding the claim for expenses incurred for past medical treatment), which included the following:
R 3 935 624.00 in respect of future loss or earnings/ earning capacity of the minor child.
R 700 000.00 in respect of general damages resulting from bodily injuries sustained.
An undertaking for payment of the future accommodation of the claimant in a hospital, or future medical services or supplying of goods related to the injuries sustained by the claimant in the collision.
